AG Faris Al Rawi taken to court


Capil Bissoon of 54 Hel­en Street Lange Park, Chaguanas, through his lawyer, Rishi Tripathi, has issued a pre-action protocol letter to Attorney General Faris Al Rawi. Bis­soon, By letter dated 2nd March 2020 Bissoon had made a request to Al Rawi under the Freedom of Information Act (FOIA) in which he requested in­formation on the “legal fees paid out to particular At­torneys dur­ing the period during the pe­riod Septem­ber 2015 – to present” The application was made “under Sec­tion 13 of the FOIA Chapter 22:02 with respect to state briefs and legal fees paid for completed and ongo­ing matters.
The letter lists several top-class lawyers including three Senior Counsels and one law firm. Several of the Attor­neys have been described as “PNM law­yers”
Bissoon’s lawyer also advised that he (Bissoon) will pay any reasonable fee associated with the copying of the said document “once notified of the costs of same”.
On May 5, 2020, the Attor­ney General advised Bissoon’s lawyer that he will not be providing the informa­tion requested. The letter above the AG refused the request.
As a consequence, Bissoon now heads to the court for a resolution of this matter. It is interesting to note that when an FOIA request was denied to UNC activist Ravi Balgobin Maharaj he appealed up to the Privy Council and won.
